"THAT in consideration of staff report ‘A01.2025 – David Chapmans Ice Cream Ltd.’ the Committee of Adjustment hereby approves minor variance application A01.2025, to zoning bylaw 37-2006, as amended, for 775284 HIGHWAY 10 being CON 1;SWTSR PT LOT 94 TO PT LOT 97, geographic Township of Glenelg to facilitate the construction of a manufacturing/processing plant with: a. Interior Side Yard, Minimum = 0 metres; b. Building Height, Maximum = 16 metres; and c. Minimum number of Parking Spaces = 97 spaces subject to the following conditions: i. THAT the owner provides a property tax certificate or, correspondence from the municipal finance department, indicating that all property taxes have been paid up-to-date with respect to the property that is subject to this decision; ii. THAT this decision applies only to the lands as indicated on ‘Schedule A – A01.2025 – David Chapmans Ice Cream’ attached to and forming part of this decision (any other variances that may appear on the Schedule that are not listed in the written decision are not authorized); 3 iii. THAT municipal water service and municipal sewer service have been provided to the development to the satisfaction of the Chief Building Official; and iv. THAT this decision expires three years from the date of decision if a building permit has not been issued."
